Annex DE — Germany (Frankfurt satellite)

AGG anti-discrimination alignment, AÜG position, works-council consultation clauses.
DE.1 Presence
Frankfurt is a satellite of the EMEA hub. All Germany-related mandates are contracted by the EMEA entity under Netherlands law, unless the Engagement Letter expressly opts into German law.
DE.2 AGG (General Equal Treatment Act)
Sercxi conducts search in a manner compliant with the AGG. Role briefs must not contain criteria that would constitute unlawful discrimination on protected grounds; Sercxi will decline or renegotiate briefs that do.
DE.3 AÜG (Employee Leasing Act)
Sercxi does not provide employee-leasing services requiring a Erlaubnis under the AÜG. Where a mandate would fall within the AÜG's scope, Sercxi will refer the Client to a licensed provider.
DE.4 Works Council
The Client is responsible for any Betriebsrat consultation obligations arising from the hire. Sercxi will accommodate reasonable process adjustments to support such consultation.
DE.5 Data Protection
German-based candidate data is processed under the GDPR as supplemented by the BDSG. Section 26 BDSG treatments apply where the Client is the controller.
